1. Acceptance of the general conditions of sale

1.1 Any person who makes online purchases (hereinafter the "Customer"), with the methods presented on the website www.barbiconi.it, declares to have read all the information provided to him during the purchase procedure and to accept these general conditions in full (hereinafter the "Conditions").

1.2 These conditions govern purchases made on the website www.barbiconi.it, in accordance with the provisions of the Consumer Code, Legislative Decree n. 206/2005, amended by Legislative Decree. n. 21/2014 and by Legislative Decree. 70/2003 on electronic commerce

2. How to purchase

2.1 The products offered for sale by Barbiconi Srl are only those present on the website of www.barbiconi.it at the time the Order is placed, as described in the relevant information sheets.

2.2 In any case, it is understood that the images accompanying the description of a product are for information purposes only and may not be perfectly representative of its characteristics but differ, for example, by color and size (also due to the browser and monitor used to access the Site and view images).

2.3 To place an Order, the Customer must fill out the relevant form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and / or products he intends to purchase. The Customer must also request if desired, the issue of a tax invoice relating to the purchase, pursuant to art. 22 DpR n. 633/1972.

2.4. Receipt of the Order is confirmed by Barbiconi Srl by with an e-mail reply, sent to the e-mail address supplied by the Customer. This confirmation message will summarize the purchase conditions, as required by the applicable legislation, as well as the data entered in the Order by the Customer.

3. Prices and methods of payment

3.1 All our prices include VAT and do not include any applicable customs duties. For information on the duties which apply to your country, please enquire at your local customs office. Private customers outside of the UE are exempt from VAT if the shipping method guarantees proper customs procedures.

3.2 While we try to ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of the merchandise you have ordered, we will give you the option of reconfirming your order at the correct price or canceling it.

3.3 Credit cards. In cases of purchase of goods with credit card payment methods, the transaction will take place through the secure server of Unicredit pagonline.

In no case and at no stage of the payment Barbiconi Srl will be able to know the information relating to the Customer's credit card, transmitted via a secure connection directly to the site of the bank that manages the transaction. No computer archive of Barbiconi Srl will keep such data and therefore in no case can Barbiconi Srl be held responsible for any fraudulent and improper use of credit cards by third parties upon payment.

3.4 PayPal. The customer can use the PayPal circuit according to the specific methods of the same.

3.5 Bank transfer

In case of purchase by bank transfer, the shipment of the goods will take place only upon actual receipt of the founds in the bank account.

For non-SEPA transfers, made from countries outside European Union, the costs and commissions must be charged to the sender (select OUR method of payment), otherwise, we will ask for the difference between what is requested and what is received.

The customer must pay the order within 10 days of the purchase confirmation date. After ten days, the order will be canceled and another one will need to be placed.

4. Delivery of products and related costs

4.1 The delivery times indicated by Barbiconi srl must be considered as purely indicative and a delay with respect to them, or any delivery made with subsequent split shipments do not entitle the Customer to refuse the delivery itself and to request compensation.

4.2 With regard to deliveries requested in countries outside the European Union, any import customs fees will be paid by the receiver. The Customer is therefore invited to contact the customs authorities of their country in advance to check the costs and any import limits.

4.3 Any damage occurred to the packaging and/or the product must be immediately stated to the courier, putting a specific indication on the delivery document of the parcel.

4.4 Any problems relating to the physical integrity, correspondence of the products received must be reported within 7 days of delivery, according to the procedures set out in this document.

4.5 We cannot be responsible for damage or loss during shipping. The case of damage or loss is extremely rare, but we will be happy to include insurance costs in the shipping quote at your request. Standard shipping quotes do not include insurance.

5 Availability
Please note that not all items are in stock when you place an order, some of them are completely handmade and therefore in certain cases they need very a long manufacturing time.

If the item is available in stock your order will be immediately delivered.
If the item is not in stock, it can be produced and restocked with a minimum and maximum delivery time. You may decide to accept or not accept the proposed delivery time.

6. Right of withdrawal

6.1 According to art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the Customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to give reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

6.2 To exercise the right of withdrawal referred to in the previous article 5.1, the Customer must send Barbiconi srl a communication, within the terms indicated, to the following email address info@barbiconi.it

6.3 In the event of withdrawal, the Customer must return the products at his own expense to Barbiconi Srl - Via di S. Caterina da Siena 58/60 - 00136 Rome - Italy within 14 (fourteen) days of said withdrawal.

The goods must be returned intact, complete with all their parts and in the original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics, and size, according to normal diligence, without any signs of wear or dirt, in compliance with the following conditions:

• the right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the purchased product (ex: accessories, complements, etc ...).

•  the withdrawal is possible only when the product is returned intact and in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, seals, etc ...).

•  shipping costs (and any customs fees, if requested) for returning the goods will be under the responsibility of the Customer.

•  the shipment, until the certificate of receipt in the warehouse indicated by Barbiconi Srl, is under the complete responsibility of the customer.

• in case of damage to the goods during the transport, Barbiconi Srl will notify the Customer, to allow him to promptly file a complaint against the courier and obtain the relative refund; the product will then be made available to the customer, simultaneously canceling the request for withdrawal.

• Barbiconi srl will not be liable in any way for damage, theft, or loss occurring during or in any case depending on the return shipment.

6.4 Barbiconi Srl will refund the Customer the full amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2, of Legislative Decree 21/14), within 14 (fourteen) days of withdrawal, using the same payment method used by the Customer for the initial transaction, unless otherwise agreed. Barbiconi Srl may suspend the refund until the returned product is received or until the Customer proves that he has correctly returned the product, whichever is earlier.

6.5 In any case, the Customer will lose the right of withdrawal in cases where Barbiconi Srl ascertains that:

• the returned product and/or its accessories, and/or its packaging are not intact.

• the product is missing its external packaging and/or its original internal packaging.

• the product lacks integral elements and/or accessories (ex. closures, laces, buckles, etc.).

In case of forfeiture of the right of withdrawal, Barbiconi srl will return the purchased product to the sender, charging the shipping costs to the sender and, if already reimbursed, the price of the product.

7. Guarantees

7.1 All products sold by Barbiconi Srl are covered by a 24 (twenty-four) month warranty for lack of conformity, pursuant to Title III of Legislative Decree no. 206/2005. To use the warranty, the Customer must keep the invoice, or the payment receipt, together with the transport document.

7.2 The warranty for lack of conformity will apply upon the condition that the product has been used correctly, in compliance with its intended use, and according to the instructions for use and washing present in the product.

7.3 In the event that, for any reason, Barbiconi Srl is unable to return a product under warranty (restored or replaced) to the Customer, or if the repair or replacement was, also due to the value of the product, excessively onerous, Barbiconi Srl will proceed with the appropriate reduction of the price paid or the refund of the entire amount paid.

7.4 In cases where the application of the guarantees provides for the return of the product, the same must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation

9. Privacy Information processing personal data

9.1 The personal data collected with the placing of the Order will be processed by Barbiconi Srl for the sole purpose of satisfying the express requests of the Customer, in compliance with EU Regulation 2016/679 and the privacy policy on the site. Any further processing will be carried out only with the express consent of the Customer.

9.2 The Customer has in any case the right to be informed, at any time, on the processing of data concerning him; to obtain confirmation of the existence of such data and processing, data updating, corrections, additions, or cancellations of the same; to request their blocking and oppose their treatment.

10. LAW AND JURISDICTION

10.1 The sales contract referred to in these Conditions and its execution is governed by Italian law and the regulation of the United Nations Convention for the International Sale of Goods. Any dispute arising from or related to the use of the website or to such Contracts shall be subject to the jurisdiction of the Italian courts.
